Does Rare or Nintendo own the minor DKR characters?

Does Rare or Nintendo own the minor DKR characters?

These characters are Drumstick, Timber, Pipsy, Bumper, and I suppose Wizpig. These are all characters that Rare created to be part of their own series, but never capitalized on. Does Nintendo own them as "Donkey Kong characters" or does Rare as "extended Rare universe" characters"?

They're owned by Rare, hence why Banjo, Conker, Tip Tup and T.T.* made an appearance in Microsoft games, whereas Nintendo owns Diddy Kong and Krunch. I even read somewhere on Scribes that Rare owns most of the DKR game (minus of course the DK characters).

I assumed there was some legal problem where nobody owned them. I always wondered why they never used Chunky, Lanky and Tiny in their games, i'd like them to be in more DK platformers.

The one I'm most interested in is Gnawty. He's appeared on both the Virtual Console DKC games and the XBLA BK remake. Is it okay for Nintendo to use Gnawty as a race, but not as an individual character? What if they had a Gnawty NPC but didn't give out his name? It's definitely a gray area I rarely hear about.

I believe Nintendo owns their rights.
Diddy Kong and Krunch for sure are owned by Nintendo.
Timber wore a Nintendo DS hat in the remake, but it seems Nintendo owns them.
However Tiptup is a mystery.
He returned in the remake, but he made a cameo appearance in Banjo Pilot after the sale...
I'm still sure Nintendo owns all the characters though.

I'm pretty sure Rare owns everything that isn't Diddy, Dixie, Tiny, Krunch, and Tricky.

You know, it'd be so nice if at least one of the companies explained how the rights for those characters and games work so the fans could finally understand it :P It'd clear up so much confusion...

I'd say that's more common sense than clout. Why not try to prevent the competition from becoming more appealing?

If Nintendo owned nothing of the GoldenEye game, there would have been nothing to stop it being released on 360. Common sense or not, if Nintendo had no copyright over the game and Rare had everything, it would have been released.
